    But, but, but, Obama assured us they acted alone! In the meantime the Saudis alerted DHS about these guys in *writing* in 2012. Homeland security is so busy demonizing Christians it isn't getting it's real job done. Napolitano needs to be fired, not that her replacement would be any better. Obama's character assessment skills are severely lacking.

    No Debate to be had. If you want to use the information to stop an imminent threat, you need not Mirandize. If you want to use it in court, you have to do it. The 5th Amendment is pretty clear, and this issue really isn't that complex. As a society, we stray from our constitutional rights at our own peril.

    @GuyFawkes That still has no relevance when it comes to 5th Amendment rights against self incrimination. Loosening constitutional rights and protections is not wise.

    Particularly on a case by case basis, because their existence makes prosecution difficult. They exist to prevent a rush to judgment, or to prevent government's making cases with little or no proof upon the premise that they can coerce the information necessary to convict from the accused. You know, like tyrants.

    Post Miranda, suspect/defendants have right to counsel; investigators are largely reigned in by other provisions which are enacted when said suspect/defendant is read their rights, which slows progress and thwarts investigative tactic.
    There is a purpose to the public safety clause and the subsequent delaying of Miranda. In the case of Tsarnaev the FBI were having good results in the interrogative process and very much wanted, even expected, the AG not to intervene. But Holder did intervene after a mere 16 hrs, sent a judge to Mirandize Tsarnaev who then of course invoked his right of silence.
    There went the intel gained by constructive interrogation.

    @GuyFawkes Actually, they legally have the rights regardless of when Miranda is read. It is unwise of law enforcement not to read the rights, doing so only creates fertile grounds for appeal, and appellate courts don't take constitutional rights lightly. Even Tsarnev has a right against self-incrimination.

    Now weren't we told they acted alone? As we find out more may be involved the question is why wasn't this known about in advance? What was missed?

    The US Constitution is NOT based on "christian" principles. It is based on the Roman Senate (for real). Our Founders originally wanted to name what is now DC "New Rome" and they even named a tributary of the Potomac the Tiber. The Capitol rotunda originally had a hole in the floor for the Roman style eternal flame that burned in the basement below. Google "Capitol Rotunda Dome Painting" and you will see George Washington as a Roman god.

    The architectural influence in D.C. is no secret, but had nothing to do with the values that were inculcated in our founding documents, founders personal letters and the Federalist papers.

    What ever name was considered for our capitol didn't come to fruition, other than Washington D.C.

    Having said that---

    Our founders being born, bred and educated in England, for the most part -- with our laws primarily coming from English common law and the Magna Carta, which is steeped in Christian principals.

    Judeo-Christian Values our mentioned in our Declaration of Independence which predates our Constitution.

    I'm pretty tired of all these articles. 4 times as many people died in the explosion in Texas and there was what, ONE article about it? But that's ok apparently because only thousands of people die every year at the expense of profit while dozens... DOZENS have died due to terrorism in the last 10 years...     It is extremely troubling that after only 16 hours, a federal magistrate entered the hospital room where Boston bomber suspect Dzhokhar Tsarnaev was being questioned by the FBI - and to the shock of federal investigators - was read his Miranda rights, lawyered up, and promptly quit talking.

    U.S. Attorney General Eric Holder told reporters over the weekend that "the decision to Mirandize was one that the magistrate made" and added that "everything was done appropriately."

    Here's the problem. Why the rush to file charges in the first place? Holder refused to declare Tsarnaev an 'enemy combatant' which would have provided authorities with a lawful avenue to continue to question him - to gather much-needed intelligence about this terrorist attack. He would still face justice in federal court, but the U.S. would have had the time it needs to get the information and intelligence that is so critical in understanding exactly what happened at the Boston Marathon.

    But, no, the Attorney General gave the OK to file charges, and after just 16 hours, the suspect was Mirandized and that was that. No more talking. No more intelligence. A vital investigative tactic shut down.

    As I told Megyn Kelly today on FOX News, the problem is that the Attorney General made a fundamental mistake in the prosecution of this case by rushing in and filing charges before federal investigators got the intelligence they needed.

    Instead of expressing concern about that aspect of the case, the Attorney General today felt compelled to remind Americans that the Justice Department is "committed to protecting innocent people against misguided acts of retaliation." No one has a problem with reminding people that we must not allow any group to be stigmatized or alienated.

    I am pleased that these new suspects have been arrested, there will probably be more later. Law Enforcement has done an excellent job so far. Thank you Law Enforcement for working hard and catching these criminals.
